
A cooperative housing society can put forward a consumer complaint against the builder for not fulfilling the promise list of amenities as mentioned in the agreement, at the time of hand over the possession to the society members.
Under the Maharashtra State Consumer Disputes Redressal Commission, the Consumer Protection (CP) Act, such complaints cannot be removed from the District Consumer Forum, only on the base that, the work is not completed within the time limit provided.
On Tuesday, The state commission has allowed an appeal of the Umda Plaza Cooperative Housing Society, at Junnar, Pune, against the District Consumer Forum’s Dismissal of its complaint at the point of the time limit. By getting stricter with the Forum, the commission has ordered them to decide the complaint on merit, within four months.
The cooperative housing society was formed in 2007, but by 2003, the possession of the flats was delivered to their respective owners. But a complaint is made by the society members, against the builder Rahil Construction, that they did not provide several amenities which are mentioned in the agreement. Amenities like parking lots, putting in place a working drainage line to the bathrooms and wash basins, proper placing of flooring, fixing of tiles on the internal road, etc., are not provided to them.
According to the District Consumer Forum, the contentions made in the consumer complaint were not within the time limited as mentioned under the Consumer Protection Act, that’s why they are dismissing the society’s complaint.
In the matter, the commission also observed that the amenities mentioned in the agreement relate to peaceful stays, is not considered by the district forum as pleaded by the advocate (Rashmi Manne) of the Appellant Society.” According to the Commission, the merit of the case is note consider by the district forum, so the complaint is required to be reopened on its merit.
